Terms & Conditions

1. General

1.1 For the purposes of this agreement:

  • “Supplier” means RS Furniture Hub and its successors and assigns.
  • “Customer” means the customer or any person acting on behalf of and with the authority of the Customer.
  • “Goods” shall have the same meaning as section 119 of the Contract and Commercial Law Act 2017 and refers to goods supplied by the Supplier to the Customer (including any supply of Services as defined below).
  • “Services” means all services supplied by the Supplier to the Customer, including any advice or recommendations (which may also include the supply of Goods).
  • “Price” refers to the costs of the Goods as agreed between the Customer and the Supplier in this Agreement.

1.2 Any instructions received by the Supplier from the Customer for the supply of Goods shall constitute acceptance of these terms and conditions. Once accepted, these terms are irrevocable and can only be modified in writing with the Supplier’s consent.

1.3 While the Supplier makes reasonable efforts to update stock details, availability may change due to unforeseen circumstances and high demand. Orders are taken on a first-come, first-served basis. If Goods are out of stock, the Supplier will attempt to notify the Customer.


2. Retention of Title

2.1 Title to the Goods passes to the Customer upon full payment. Until full payment:

  • If Goods are incorporated into other products, the Supplier retains value in them.
  • The Customer holds Goods as fiduciary agent and bailee for the Supplier.
  • If the Customer resells the Goods, proceeds shall be held in trust for the Supplier.

2.2 If payment is overdue, the Supplier may enter the Customer’s premises to inspect or reclaim Goods without liability for any damage caused.

2.3 The Customer indemnifies the Supplier against liability arising from exercising its rights under Clause 2.2.


3. Information and Privacy Act

3.1 The Customer authorizes the Supplier to:

  • Collect relevant information from third parties.
  • Retain and use that information for business operations.
  • Share information to facilitate debt collection.

3.2 Information will be:

  • Securely stored at the Supplier’s office.
  • Accessible only to employees and agents as necessary.
  • Available for Customer access and correction upon request.

4. Risk

4.1 Risk in Goods passes to the Customer upon delivery.


5. Delivery and Freight

5.1 Unless agreed otherwise, the Customer is responsible for transportation costs. The Supplier aims to meet delivery schedules but is not liable for delays beyond its control.

5.2 The Supplier is not liable for damages or delays caused by circumstances beyond its control.

5.3 Delivery fees vary by goods and location. Re-delivery fees apply if a scheduled delivery returns to the Supplier for reasons outside the Supplier’s control.

5.4 Additional fees apply for deliveries requiring stairs or elevator access. The Customer must notify the Supplier in advance.


6. Pricing

6.1 Prices are confirmed in writing at the time of order but may change without notice. Freight, insurance, and assembly fees are additional unless otherwise agreed in writing.


7. Terms of Payment

7.1 Full payment is required at the time of order.

7.2 Credit card payments must be made in-store using Visa, MasterCard, or Q Card.

7.3 Payments via direct credit must be deposited into the Supplier’s bank account, details of which will be provided upon order confirmation.

7.4 The Customer warrants they are over 18 and have the legal capacity to enter into contracts.


8. Consumer Guarantees Act

8.1 Nothing in these terms contracts out of the Consumer Guarantees Act 1993 unless permitted by law.

8.2 If the Customer purchases Goods for business purposes, the Act does not apply.

8.3 The Supplier provides no guarantees beyond those required by law or explicitly stated in writing.


9. Warranty

9.1 Goods are subject to manufacturer warranties and the Consumer Guarantees Act 1993.

9.2 No additional warranties apply unless explicitly stated in writing.

9.3 Warranties apply only to Goods used within New Zealand.

9.4 The Supplier offers at least a one-year warranty on all Goods.


10. Cancellations and Refunds

10.1 Subject to the Consumer Guarantees Act 1993:

  • Custom-made Goods cannot be canceled or refunded.
  • Returned Goods must be in new, saleable condition.

10.2 The Customer is responsible for ensuring Goods fit their intended space before purchase.


11. Defects

11.1 The Customer must inspect Goods upon delivery and notify the Supplier of any defects or discrepancies within a reasonable timeframe.


12. Miscellaneous

12.1 If any term is found invalid, the remaining terms remain unaffected.

12.2 Goods are supplied under New Zealand law.

12.3 Neither party is liable for events beyond their control (e.g., acts of God, war, strikes).

12.4 The Supplier’s directors, shareholders, or employees are not personally liable under this Agreement.


13. Subscription Terms & Conditions

13.1 Subscribing to the RS Furniture Hub Newsletter constitutes consent to receive newsletters.

13.2 By accepting the Terms & Conditions, the Customer agrees to RS Furniture Hub collecting their personal information for sales purposes.

13.3 Personal information is not disclosed externally without consent.

13.4 Customers may unsubscribe at any time via the provided link in email communications.


14. Finance Application Terms & Conditions

14.1 Loan and insurance access is subject to eligibility and approval. Insurance is only available when taking a loan arranged by the Supplier.

14.2 Applications not completed within 24 hours will not be reviewed.

14.3 Declined applications do not constitute a service provided by the Supplier.

14.4 The Supplier does not provide financial advice regarding loans or insurance.

14.5 Loan applicants must:

  • Permanently reside in New Zealand.
  • Be at least 18 years old at the time of application.

14.6 The Supplier is authorized to discuss applications with relevant Providers.

14.7 The Customer authorizes the Supplier to conduct necessary credit and verification checks.


Delivery Policy

7-10 working days delivery time once ordered is placed and when stock is available.

Pricing Policy

Prices are confirmed in writing at the time of order but may change without notice. Freight, insurance, and assembly fees are additional unless otherwise agreed in writing.

All prices are shown in New Zealand Dollars (NZD) and inclusive of GST unless otherwise stated. All transactions will be charged in NZD. RS Furniture Hub is a NZ registered company
